News: Developer violated norms, say residents of GPL Eden Heights-21-08-2021

GURUGRAM: Residents of GPL Eden Heights in Sector 70 have raised concerns over the alleged violation of the conditions of the project licence. They have sought a structural inspection of the society by the department of town and country planning (DTCP), alleging that the conditions of the completion certificate have not been fully complied with by the developer.
Residents further said the developer has not yet transferred the community building to them. “Also, the builder has not refunded the interest-free maintenance security (IFMS) collected from us, which amounts to Rs 15 crore, and is earning interest. They have also collected Rs 50,000 per flat as club membership fee, but the building is closed. According to the bilateral agreement with DTCP, the builder isn’t allowed to recover any amount for internal community building,” said Biraj Bhadra, a resident.
Due to improper water-proofing of the park, seepage has been reported in the basement area, which is severely affecting the structure of the residential towers, residents said. “The rainwater harvesting system isn’t operational and the sewage treatment installed in the society is also operating under capacity. It is processing only 300 kilolitres a day (KLD) against the required capacity of 550 KLD,” another resident said.

According to residents, several complaints have been filed with the authorities concerned for several years now, but no action taken.

“It is the responsibility of the builder to ensure maintenance of the society for five years from the date the completion certificate is obtained. Moreover, work amounting to nearly Rs 1.4 crore is pending, which the builder should have ideally completed before handing over the society to the RWA. Now, we have filed a complaint on the CM window hoping for some relief,” said Jasvinder Singh Dhir, a resident.

 

A representative of the developer, however, maintained that there is no seepage issue in the society. “We have already handed over the society to the elected RWA and maintenance is being taken care of by the RWA for the past two years. We have the ownership of the club and we will give our reply to DTCP officials in an upcoming meeting.”

When contacted, senior town planner Sanjeev Mann said, “We have scheduled a meeting on September 3 and called both the parties to discuss the matter. Action will be taken accordingly.”
