The High Court order had come on the petition filed by Preeti Satija and Shivani Chopra who had purchased commercial units in the property.

“Both of us purchased the properties from Dynamic Universal Limited. Later we realised multiple legalities with the building and raised it at various platform. MCG, which was supposed to take action against the builder is not doing so despite order from the High Court,” said Lovleen Kumar Satija, husband of Preeti Satija.

According to the petition filed by Satija, the sanction was given for the building meant for office complex exclusively use by the company.

However, the built up commercial complex has been subdivided into various office units, which have been sold to different persons without obtaining a licence from the Director, Town & Country Planning Department, Haryana, as required under the sections 3 and 7 of the Haryana Development & Regulation of Urban Areas Act 1975 (Act 8 of 1975).

“We have submitted number of applications under the Right to Information Act that why the action is not being taken against the Directors of the Company. Even a complaint was lodged to the Hon’ble Chief Minister, Haryana, but no action has been taken on the application submitted by the petitioners. The Joint Commissioner has written a letter to the SHO for the registration of an FIR but even that has not been registered,” Satija said.

The buyer has also alleged that the building - Palm Court was completed without obtaining occupation certificate as required under then applicable Haryana Municipal building Bye-Laws, 1982.

“On the basis of the complaint submitted by the us, the Municipal Corporation, Gurugram was directed to hold an enquiry with regard to obtaining of a licence from the Director, Town & Country Planning, Haryana. The Commissioner, Municipal Corporation, Gurugram, after holding detailed enquiry wrote a letter to the Dynamic Universal Limited and alleged sanction was revoked. In the High Court, MCG, has repeatedly said that they will take concrete action. Despite restrictions on sale and purchase on the property, transactions are happening. We urge the authorities to take immediate action,” said Ami Chopra, husband of Shivani Chopra.

Sanjeev Singla, joint commissioner of MCG, did not respond to the repeated phone calls and message.

Sachin Dewan, director of Dynamic Universal Ltd said that he is not aware of any such court order.
