News: Start work or pay Rs 1 crore fine a day, H-Rera tells Greenopolis builders -17-01-2020

The Haryana Real Estate Appellate Tribunal had earlier rejected developers’ plea to stay the order passed by H-Rera in January last year, where H-Rera imposed a penalty on the developers and attached 10 acres of their land for not completing the project on time.

 

GURUGRAM: The Haryana Real Estate Regulatory Authority (H-Rera) has directed the developers of the much-delayed Greenopolis housing project to start construction by February 1, failing which a penalty of Rs 1 crore per day will be imposed on them.

In a hearing on Thursday, the regulatory authority further directed the developers of the Secor 89 project — Orris Infrastructure and The 3C Company — to complete the first phase by April 30, otherwise they will have to cough up a penalty of Rs 1 crore per day.

Prior to the meeting, homebuyers met deputy chief minister Dushyant Chautala to seek his help in getting their homes, which have been delayed by over four years. After meeting the buyers, Chautala directed H-Rera chief K K Khandelwal to provide a solution to them at the earliest.

Despite attempts by TOI, Orris representatives remained unavailable for comments on their next step after their plea was dismissed.

The Haryana Real Estate Appellate Tribunal had earlier this month rejected the developers’ plea to stay the order passed by H-Rera in January last year. In its earlier order, H-Rera had imposed a penalty on the developers and attached 10 acres of their land for not completing the project on time.

Vijay Raj, who was leading the group of homebuyers, said: “Deputy CM Chautala assured us of action. He had a meeting with Khandelwal and some of us and was very firm that Rera should use all its powers to get our homes built.”

He added, “After over 4.5 years of fighting with the developers and about 15 months of taking the case up with H-Rera, we are now tired and want the authority to gives their homes. We are no longer in a position to pay both rents and EMIs.”

Later during the hearing, Khandelwal ordered the developers to submit detailed plans for phases 2 and 3 of the project within 15 days. H-Rera asked them to give in writing within seven days the reason why they should all not be sent to jail.

“The January 23, 2019 order had a clear roadmap of funding and construction. It’s been a year now, but the builders haven’t followed a single point in the order and the authority earlier failed to act or penalise them. H-Rera’s execution order is long overdue as the hearing was postponed for four times. We had lost hope,” said Dimpy Dewan, a buyer.

She added that the developers have over Rs 50 crore lying in the bank for Greenopolis alone, and H-Rera could auction 10 acres of land owned by Orris Infrastructure. “3C also has property worth around Rs 200 crores which could be auctioned to complete the project,” she said.

Advocate Shekhar Verma, who is representing Greenopolis homebuyers in the case, said the regulatory authority should “go ahead full throttle to ensure completion of Greenopolis project and take action against the errant promoters.”
